Advisory Guide

Buying Swiss Property with a C Permit

The Swiss C permit (Niederlassungsbewilligung / autorisation d'établissement) is the settlement permit — the most favourable permit status for foreign nationals in Switzerland. C permit holders are fully exempt from Lex Koller and may acquire any residential property in Switzerland without restriction.

What is the C Permit?

The C permit (Niederlassungsbewilligung) is the Swiss settlement permit — an indefinite residence permit granted to foreign nationals who have resided in Switzerland for a qualifying period. It is the highest-status residence permit available to foreign nationals in Switzerland, short of Swiss citizenship.

The qualifying period for a C permit varies by nationality:

EU/EFTA nationals

Generally after 5 years of continuous residence with a B permit

Non-EU/EFTA nationals (certain countries)

Generally after 5 years of continuous residence with a B permit (bilateral agreements apply)

Non-EU/EFTA nationals (general)

Generally after 10 years of continuous residence with a B permit

Spouses of Swiss nationals

Reduced qualifying periods may apply

Qualifying periods are subject to change and depend on individual circumstances. Confirm current requirements with the relevant cantonal migration authority.

Property Rights for C Permit Holders

C permit holders are fully exempt from Lex Koller. They are treated as equivalent to Swiss nationals for all property acquisition purposes. This means:

May acquire any residential property in Switzerland without restriction

May acquire a primary residence, secondary residence, holiday home or investment property

No cantonal authorisation required under Lex Koller

No size limits apply under Lex Koller

May acquire property in any canton — including Geneva, Zurich, Basel and all other cantons

May acquire multiple properties

May acquire properties in non-tourist zones

Weber Act still applies to second homes (20% cap per commune) — this applies to all buyers including Swiss nationals

The Standard Swiss Property Acquisition Process for C Permit Holders

C permit holders follow the standard Swiss property acquisition process, which applies to all buyers (Swiss nationals and C permit holders alike):

01

Property identification and due diligence

Identify the property, review the land registry extract (Grundbuchauszug), assess the title, encumbrances, building permits and any applicable restrictions.

02

Negotiation and agreement

Agree the purchase price and terms with the seller. A preliminary agreement (Vorvertrag) may be entered into, though this is not always required.

03

Notarial contract preparation

A Swiss notary prepares the purchase contract (Kaufvertrag). In Switzerland, all residential property transactions must be notarially authenticated.

04

Signing and payment

The purchase contract is signed before the notary. The purchase price is paid, typically through a Swiss bank account.

05

Land registry registration

The notary registers the transfer of ownership in the land registry (Grundbuch). The buyer becomes the registered owner upon registration.

Transitioning from B to C Permit

Non-EU/EFTA nationals who currently hold a B permit and are approaching the qualifying period for a C permit may wish to consider the timing of their property acquisition in relation to their permit status.

Acquiring a C permit before purchasing property eliminates Lex Koller restrictions entirely and opens up the full Swiss property market — including Geneva, Zurich, Basel and all other cantons without tourist zones. This may significantly expand the range of available properties and locations.

Specialist immigration and legal advice should be obtained to assess the timing and implications of permit transitions in the context of a planned property acquisition.
